第一章 总 则 Chapter One, General Provisions

第一条 为保障社会主义市场经济健康发展,鼓励和保护公平竞争,制止不正当竞争,保护经营者和消费者的合法权益,依据《中华人民共和国反不正当竞争法》等有关法律、法规的规定,结合本省实际,制定本条例。Article One. The Regulations herein are formulated according to the Law of the People's Republic of China for Countering Unfair Competition as well as other relevant laws and regulations, in light of the actual circumstances of the Province, with the purpose of safeguarding the healthy development of the socialist market economy, encouraging and protecting fair competitions, stopping acts of unfair competitions, and defending the lawful rights and interests of operators and consumers.

第二条 凡在本省行政区域内从事商品经营或营利性服务(以下所称商品包括服务)的经营者,必须遵守本条例。Article Two. The Regulations apply to any operator that is engaged in commodity marketing or commercial service provision (the “commodities” referred to hereunder include services) within the administrative region of the Province.

第三条 经营者在市场交易中,应当遵循自愿、平等、公平、诚实信用的原则,遵守公认的商业道德。 Article Three. In carrying out transactions in the market, operators shall follow the principle of voluntariness, equality, fairness, honesty and credibility, and observe the generally recognized business ethics.

第四条 县级以上人民政府工商行政管理部门负责对不正当竞争行为进行监督检查;法律、行政法规规定由其他部门监督检查的,从其规定。Article Four. Administrative departments for industry and commerce of people’s governments above the county level shall be responsible for the supervision and investigation of any act of unfair competition; where any law or administrative regulation designates other departments to be responsible for the supervision and investigation, such provision shall be deferred to.

第五条 各级人民政府鼓励、支持和保护一切组织和个人对不正当竞争行为进行社会监督。 Article Five. The people's governments at various levels shall encourage, support and protect any organization or individual to supervise from the society any act of unfair competition.
任何组织和个人都有权向监督检查部门举报不正当竞争行为。监督检查部门对举报、协助查处不正当竞争行为的人员,应当为其保密,并按有关规定予以奖励。Any organization or individual shall have the right to disclose any act of unfair competition to the department for supervision and investigation, which shall keep confidential the information of the person who has disclosed or assisted in investigating the act of unfair competition, and shall give rewards to him/her according to relevant provisions.
国家机关工作人员不得参与、支持、包庇不正当竞争行为。Functionaries of state organs shall not support or cover up acts of unfair competition.

第二章 不正当竞争行为 Chapter Two, Acts of Unfair Competition

第六条 经营者不得采用下列手段假冒他人的注册商标:Article Six. Operators shall not adopt any of the following unfair means to counterfeit the registered trademark of any other party:
(一)未经注册商标所有人的许可,在同一种或者类似商品上使用与其注册商标相同或近似的商标;
(二)伪造、擅自制造他人注册商标标识或者销售伪造、擅自制造的他人注册商标标识。
(三)销售明知是假冒他人注册商标的商品;

1. Using on a commodity that is similar or of the same type the trademark that is identical or similar to the registered trademark of any other party without the permission of that party;
2. Forging or making at discretion the registered trademark logo of any other party; or selling a forged or discretionarily made registered trademark logo of any other party;
3. Selling any commodity that is evidently using the forged registered trademark of any other party;

第七条 经营者不得擅自使用知名商品特有的名称、包装、装潢,或者使用与知名商品近似的名称、包装、装潢,造成和他人的知名商品相混淆,使消费者误认为是该知名商品。 Article Seven. Operators shall not use at discretion the exclusive names, packages and decorations of a well-known commodity, or use the names, packages and decorations that are easily confused with those of a well-known commodity, so as to lead the consumers to believing that a commodity is that well-known commodity.
前款所称知名商品指: The above-mentioned “well-known commodity” means:
(一)经国家授权机关认定的驰名商标或者著名商标的商品;
(二)在市场上具有一定知名度,为相关消费者所知悉的商品。

1. Any commodity that has been recognized by the authorized authority of the state as of a famous trademark or well-known trademark;
2. Any commodity that has a certain popularity on the market and is familiar to the relevant consumers.

第八条 经营者不得擅自使用他人的企业名称、姓名、字号或者代表其名称、姓名的标志、图形、文字、代号,引人误认为是他人的商品。 Article Eight. Operators shall not use at discretion the name or company name of any other party, or the logo, icon, text or code that represents the name or company name, so as to lead the people to believing that a commodity is the other party’s commodity.

第九条 经营者不得采用下列手段,对商品质量作引人误解的虚假表示:Article Nine. Operators shall not use any of the following approaches to give any misleading indication on the quality of a commodity:

(一)伪造、冒用或者使用已被取消的认证标志或者名优标志等质量标志;
(二)伪造、冒用或者使用已被取消的质量检验合格证明、许可证、专利号或者监制单位名称;
(三)伪造或者冒用企业名称、地址,伪造或者冒用商品产地;
(四)虚假表示商品规格、等级、制作成份及其名称和含量;
(五)伪造或者模糊标注生产日期、安全使用期或者失效日期等。
1. Forging, imitating or using any certification mark, high quality well-known goods mark and any other quality mark that has been canceled;
2. Forging, imitating or using any quality examination certificate, license, patent number or name of the supervising unit that has been canceled;
3. Forging or imitating the name or address of another company, or forging or imitating the place of production of a commodity;
4. Indicating in a fraudulent manner the specification, class, production ingredients, name or net content of a commodity;
5. Forging or blurring the production date, safe use date or expiry date of a commodity.
前款所称商品产地指商品生产地、制造地、加工地(包括农副产品的生长地或者养殖地)。 The above-mentioned place of production of a commodity means the place of production, place of manufacture or place of processing (including the place of growing or place of raising in case of an agricultural and sideline product) of a commodity.

第十条 经营者不得利用下列手段对商品价格、质量、性能、用途、生产者、制作成份、有效期限、产地、售后服务以及对推销商品、提供服务附带赠送礼品的品种和数量等方面作虚假宣传: Article Ten. Operators shall not use any of the following approaches to promulgate in a fraudulent manner the price, quality, performance, usage, manufacturer, production ingredients, valid period, place of production and after-sales service of a commodity, or the type and quality of gifts that are attached to a commodity promotion or service provision:
(一)广告宣传;
(二)雇佣或伙同他人进行欺骗性的销售诱导;
(三)虚假的现场演示和说明;
(四)张贴、散发、邮寄虚假的产品说明书和其他宣传材料;
(五)利用新闻媒介作虚假的宣传报道。
1. Advertisement promotion;
2. Employing or working with others to entice any fraudulent sale;
3. Fraudulent on-the-spot demonstration or illustration;
4. Posting, distributing or mailing any fraudulent product description or other promotion materials;
5. Giving fraudulent promotions and reports by making use of the news media.
广告的经营者应对广告的真实性负责,不得在明知或者应知的情况下,代理、设计、制作、发布虚假广告。 Advertising operators shall be responsible for the authenticity of advertisements, and shall not act as the agent for, design, produce or distribute any fraudulent advertisements when they are aware or should be aware of the truth.

第十一条 经营者不得捏造、散布虚伪事实,损害竞争对手的商业信誉、商品声誉。经营者不得利用广告贬低其他经营者的商品。 Article Eleven. Operators shall not fabricate or distribute any false information to damage the business credit or commodity credit of its competitors. Operators shall not denounce the commodities of other operators in advertisements.

第十二条 经营者不得以排挤竞争对手为目的,以低于成本的价格销售商品。Article Twelve. Operators shall not sell any commodity in a price that is lower than the cost of the commodity in order to squeeze out their competitors.

有下列情形之一的,不属于前款规定的不正当竞争行为: The following acts do not belong to an act of unfair competitions mentioned above:
(一)销售鲜活商品;
(二)处理有效期限即将到期的商品或者其他积压的商品;
(三)季节性降价;
(四)因清偿债务、转产、歇业而降价销售商品。
1. Selling fresh or live commodities;
2. Disposing any commodity whose valid period is going to expire or any other overstock commodity;
3. Seasonal price discounts;
4. Selling any commodity due to debt liquidation, change of business, or closedown of business.

第十三条 经营者销售商品不得违背消费者的意愿搭售商品或者附加其他不合理的条件。 Article Thirteen. When selling commodities, operators shall not attach any other commodities for sale or attach any other unreasonable conditions against the will of the consumers.

第十四条 经营者不得实施下列强制交易行为: Article Fourteen. Operators shall not execute any of the following forced transactions:
(一)胁迫他人同自己或者他人之间进行交易:
(二)胁迫竞争对手回避或者放弃与自己或者他人进行竞争;
(三)阻碍他人之间建立正常的交易;
(四)扰乱或者妨碍竞争对手的正常经营活动。
1. Coercing any other party to do a transaction with him/herself or any third party;
2. Forcing a competitor to avoid or give up competing with him/her or any third party;
3. Impairing a normal transaction to be established between others;
4. Disrupting or impairing the normal business activities of a competitor.

第十五条 经营者不得从事下列有奖销售: Article Fifteen. Operator shall not make any of the following kinds of sale with prizes attached:
(一)谎称有奖或对所设奖的种类、中奖概率、获奖金额、获奖方法、开奖日期等作虚假的宣传;
(二)故意让内定人员中奖;
(三)故意将设有中奖标志的商品、奖券不投放市场或不与商品、奖券同时投放市场,或者故意将带有不同奖金额或奖品标志的商品、奖券按不同时间投放市场;
(四)抽奖式的有奖销售,最高奖的金额不得超过5000元。以物品或者其他方式作为奖励的,按照同期市场相同商品的价格折算,其金额不得超过5000元。
(五)其他欺骗性有奖销售行为。
1. Falsely claiming the existence of prizes, or making any fraudulent promotion on the type, winning percentage, prize amount, winning methods and prize awarding date;
2. Intentionally causing previously chosen people to win the prizes;
3. Intentionally putting the commodities or lottery tickets with prizes away from the market, or not putting them into the market together with other commodities and lottery tickets, or intentionally putting into the market at different times the commodities and lottery tickets with different prize amounts or prize marks;
4. The maximum amount of the prize of any sale with prizes attached shall not exceed RMB 5,000 Yuan. Where a good or other object is used as the prize, its price shall be calculated according to the price of a same commodity on the market at the same period, and the amount shall not exceed RMB 5,000 Yuan.
5. Any other fraudulent acts of sale with prizes attached.

经营者不得利用有奖销售手段推销质次价高的商品。Operators shall not promote the sale of inferior but high-prized goods by offering prizes.

第十六条 经营者不得采用财物、旅游度假及其他手段进行贿赂以销售或者购买商品。在帐外暗中给予对方单位或者个人回扣的,以行贿论处;对方单位或者个人在帐外暗中收受回扣的,以受贿论处。 Article Sixteen. Operators shall not make any bribe by offering property, tourist holidays or any other means for the sale or purchase of a commodity. Where an operator gives any kickback to the other unit or individual stealthily from outside its accounts, it shall be disposed as bribery; where the other unit or individual stealthily takes any kickback from outside its accounts, it shall also be disposed as bribery.

经营者销售或者购买商品,可用明示方式给对方折扣,可给中间人佣金,但必须如实入帐。接受折扣、佣金的经营者必须如实入帐。 Operators may give discounts to the other party or give brokerages to the intermediary openly for the sale or purchase of any commodity, but must record it in a truthful manner in to the account. Operators must record into the account in a truthful manner any discount or brokerage accepted.

第十七条 经营者不得采用下列手段侵犯商业秘密: Article Seventeen. Operators shall not make any infringement on business secrets by any of the following methods:

(一)以盗窃、利诱、胁迫或者其他不正当手段获取权利人的商业秘密;
(二)披露、使用或者允许他人使用以前项手段获取的权利人的商业秘密;
(三)违反约定或者违反权利人有关保守商业秘密的要求,披露、使用或者允许他人使用其所掌握权利人的商业秘密。
1. Obtaining business secrets from the owner of the right by stealing, promising of gain, resorting to coercion or other illegitimate means;
2. Disclosing, using or allowing others to use the business secrets of the owner of the right obtained by the means mentioned in the preceding item;
3. Disclosing, using or allowing others to use the business secrets that it has obtained by breaking an engagement or disregarding the requirements of the owner of the right to keep the business secrets.

明知或者应知前款所列违法行为,获取、使用或者披露权利人的商业秘密,视为侵犯商业秘密。Where any party obtains, uses or discloses the business secrets of others when he/she has or should have full knowledge of the illegal acts mentioned in the preceding section, he/she shall be deemed to have infringed on the business secrets of others.

第十八条 投标者和投标者、投标者和招标者不得相互串通,采取下列手段以排挤其他竞争对手: Article Eighteen. Tenderers and tenderers, tenderees and tender inviting parties shall not conspire with each other to exclude other competitors from fair competition in the following approaches:
(一)招标者之间相互约定,一致抬高或者压低投标报价;
(二)招标者之间相互约定,在类似招标项目中轮流以高价位或者低价位中标;
(三)投标者之间就标价以外其他事项进行串通,以排挤其他竞争对手;
(四)招标者在公开开标前,私下开启标书,并将其他投标人的投标情况告知尚未报送标书的其他投标者,或者协助投标者撤换标书,更改报价;
(五)招标者向投标者泄露标底;
(六)招标者在要求投标者就其标书澄清事项时,故意暗示或者作引导性提问,以促成该投标者中标;
(七)投标者与招标者商定,在公开招标时压低或者抬高标价,中标后再给投标者或者招标者额外补偿
(八)招标者预先内定中标者,在确定中标者时采用不正当的做法决定取舍;
(九)投标者通过贿赂等不正当手段,使招标者在审查、评定标书时,对同样的标书实行差别对待;
(十)其他相互勾结,以排挤竞争对手公平竞争的行为。
1. Tenderers submit tenders in collusion with one another to force the tender price up or down;
2. Tenderers submit tenders in collusion with one another to win out in similar tender invitation projects with a high price or a low price;
3. Tenderers conspire with one another on issues other than the tender price in order to exclude the other competitors;
4. Before the official opening of a tender, a tender inviting party opens the tender documents in private, and informs the tendering information of tenderers to other tenderers that have not submitted the tender documents, or assists tenderers in replacing their tender documents and changing the tender price;
5. The tender inviting party discloses the base number of a tender to any tenderer;
6. When requiring a tenderer to clarify any point in his/her tender documents, the tender inviting party gives hints or raises instructive questions by design so as to facilitate the tenderer to win out in the tender;
7. The tender inviting party and a tenderer have agreed between them to force the tender price to go up or down at the public tender, and give compensation to the successful tenderer or the tender inviting party after the tender closes.
8. The tender inviting party decides in advance internally the successful tenderer, and adopts improper criteria when making the decision on the successful tenderer;
9. The tenderers makes the tender inviting party to treat the tender documents with the same contents differently when reviewing and evaluating the tender documents by giving them bribes or by other improper means;
10. Any other conspiratorial act in order to exclude the competitors from fair competition.

第十九条 公用企业或者其他依法具有独占地位的经营者,不得采取下列手段,以排挤其他经营者的公平竞争: Article Nineteen. A public institution or any other operator that dominates a monopoly position according to relevant laws shall not adopt any of the following approaches to exclude other operators from fair competition:
(一)限定消费者购买和使用其提供的或其指定的经营者提供的商品;
(二)强制消费者购买其提供的或其指定的经营者提供的不必要的商品及配件;
(三)以检验商品质量、性能为由,阻碍消费者购买、使用其他经营者提供的符合技术标准要求的其他商品;
(四)对不接受其不合理条件的消费者,拒绝、中断或者减少应由其供应的相关商品,或者滥收费用;
(五)擅自改变国家确定的收费标准,损害消费者或者竞争对手的利益;
(六)排挤竞争对手的其他不正当手段。
1. Restricting consumers to purchase or use the commodities provided by itself or by another operator designated by it;
2. Forcing consumers to purchase any commodity or accessory provided by it or by another operator designated by it;
3. Obstructing consumers to purchase or use other commodities that meet the technological standards and requirements and that are provided by other operators by making the excuse of examining the quality or performance of these commodities;
4. Refusing, discontinuing or reducing the supply of a relevant commodity or charging indiscriminate fees to consumers that refuse to accept its unreasonable conditions;
5. Changing at discretion the fee standards provided by the state, which impairs the interests of its consumers or competitors;
6. Other improper approaches that exclude the competitors.

第二十条 政府及其所属部门不得滥用行政权力,限定他人购买其指定的经营者的商品,限制其他经营者正当的经营活动。Article Twenty. Governments and their subordinate departments shall not misuse their administrative powers to restrict others to purchase any commodity of an operator designated by them, or restrict the proper business activities of other operators.

政府及其所属部门不得滥用行政权力,限制外地商品进入本地市场,或者本地商品流向外地市场。Governments and their subordinate departments shall not misuse their administrative powers to restrict commodities from other provinces to enter the local markets, or restrict local commodities to enter markets outside the Province.

第三章 监督检查
Chapter Three, Supervision and Investigation

第二十一条 监督检查部门在监督检查不正当竞争行为时,可行使下列职权:Article Twenty-one. In monitoring and investigating acts of unfair competition, supervision and inspection departments shall be entitled to exercise the following functions and powers:
(一)按照规定程序询问被检查的经营者、利害关系人和证明人,并要求提供有关证明材料或情况;
(二)查询、复制与不正当竞争行为有关的合同、协议、帐册、单据、文件、记录、业务函电和其他资料;
(三)检查本条例第六至九条规定的与不正当竞争行为有关的财物时,可责令被检查的经营者说明该商品的来源和数量、暂停销售、听候查处,经营者不得转移、隐匿、销毁该财物;发现被检查财物有可能被转移、隐匿、销毁时,经县级以上人民政府监督检查部门负责人批准,可对有关的财物予以查封、扣留,但查封、扣留时间不得超过3个月;对不易保存的物品应及时处理。

1. Questioning the operators under investigation, interested parties and witnesses in accordance with the prescribed procedures and requiring them to provide evidential material or other information;
2. Consulting and copying contracts, agreements, account books, bills, documents, records, business correspondence and other materials related to acts of unfair competition;
3. When inspecting property related to acts of unfair competition as stipulated in Article Six to Article Nine of the Regulations, requesting operators under investigation to explain the source and quantity of the commodities, to temporarily stop selling them, pending inspection, during which period the operators shall not remove, conceal or destroy the properties; where it is found that the properties are possibly removed, concealed or destroyed, they may be seized or detained subject to the approval of the person in charge of the department for supervision and investigation of the people’s government above the county level, but the period of the seizure or detainment shall not exceed 3 months; goods that are not suitable for storage shall be disposed in a timely manner.

第二十二条 监督检查部门在监督检查不正当竞争行为时,被检查的经营者、利害关系人和证明人应当如实提供有关资料或情况。 Article Twenty-two. When the supervision and inspection departments are supervising and investigating acts of unfair competition, the operators under investigation, interested parties and witnesses shall provide them with relevant data or information in a truthful manner.

第二十三条 经营者的合法权益受到不正当竞争行为侵害时,有权向监督检查部门投诉;监督检查部门收到当事人的投诉后,应当在10日内作出是否受理的决定,并通知当事人。监督检查部门对决定受理的投诉,应当在法律、法规规定的期限内作出处理。Article Twenty-three. Where the legal rights and interests of any operator are impaired by any act of unfair competition, he/she shall have the right to file a complaint to the supervision and inspection department, which shall, within 10 days after receiving the complaint, make the decision as whether to accept and hear the case or not, and inform the party concerned of the decision. Where the supervision and inspection department decides to accept and hear the complaint, it shall dispose it within a period specified by relevant laws and regulations.
第二十四条 监督检查部门应当定期向社会公布有严重不正当竞争行为的经营者及其主要违法事实。 Article Twenty-four. The supervision and inspection department shall announce to the society regularly the operators that have committed serious acts of unfair competition, as well as the main facts of their acts.

第二十五条 监督检查部门工作人员在监督检查不正当竞争行为时,应当出示检查证件,对不出示检查证件的,被检查者有权拒绝检查。Article Twenty-five. Functionaries in the supervision and inspection department shall present their investigation certificates when supervising or investigating into an act of unfair competition, otherwise the investigated party shall have the right to reject to be inspected.

第四章 法律责任 Chapter Four, Legal Liabilities

第二十六条 经营者违反本条例规定,给被侵害者造成损害的,应当承担损害赔偿责任;被侵害者的损失难以计算的,赔偿额为侵权人在侵权期间因侵权所获得的利润,并应当承担被侵害者因调查该经营者侵害其合法权益的不正当竞争行为所支付的合理费用。Article Twenty-six. Where an operator breaches any provisions in the Regulations, which causes any loss to the infringed party, the operator shall bear the responsibility to compensate the loss; where the loss of the infringed party is difficult to calculate, the amount of the compensation shall be the profit the infringer has received during his/her act of infringement, and the infringer shall bear the reasonable cost paid by the infringed party for the investigation of the operator’s act of unfair competition that has impaired the legal interest of the infringed party.

被侵害者的合法权益受到不正当竞争行为损害的,可以向人民法院提起诉讼。A lawsuit may be filed to a people’s court where the legal interests of the infringed party are impaired by any act of unfair competition.

第二十七条 经营者违反本条例第六条规定假冒他人注册商标的,依照《中华人民共和国商标法实施细则》第四十三条的规定处罚。 Article Twenty-seven. Where an operator violates the provision in Article Six of the Regulations by forging the trademark of any other party, he/she shall be punished according to provisions in Article Forty-three, the Enforcement Regulations of the Law of the People’s Republic of China on Trademarks.

第二十八条 经营者违反本条例第七条规定擅自使用知名商品特有的名称、包装、装潢,或者使用与知名商品近似的名称、包装、装潢,造成和他人的知名商品相混淆,使消费者误认为是该知名商品的,由监督检查部门责令停止违法行为,没收违法所得,并可根据情节处以违法所得一倍以上三倍以下的罚款;情节严重的,可以吊销营业执照;销售伪劣商品,构成犯罪的,依法追究刑事责任。 Article Twenty-eight. Where an operator violates the provision in Article Seven of the Regulations by using at discretion the exclusive names, packages and decorations of a well-known commodity, or using the names, packages and decorations that are easily confused with those of a well-known commodity so as to lead the consumers to believing that a commodity is that well-known commodity, the supervision and investigation department shall require the operator to stop this illegal act, forfeit the illegitimate income, and may impose a penalty that is not less than one time but not more than three times of its illegitimate income, depending on the seriousness of the act; where the act is very serious, the department may cancel the business license of the operator; where the operator sells false and inferior commodities and a crime is constituted, the operator shall be prosecuted his/her criminal liabilities.

监督检查部门可以收缴尚未使用的侵权物品的包装和装潢,责令并监督侵权人消除现有商品上侵权的商品名称、包装和装潢,收缴从事违法活动的专用工具。采取上述措施仍不足以制止侵权行为时,监督检查部门可以责令并监督销毁侵权物品。 The supervision and inspection department may forfeit the packages and decorations of the infringing goods that are not used, request and supervise the infringer to remove the infringing commodity names, packages and decorations on the existing commodities, and forfeit the special tools used in the illegal act. Where the above-mentioned measures are insufficient to stop the infringing act, the supervision and inspection department may require and supervise the destruction of these infringing goods.

第二十九条 经营者违反本条例第八条规定擅自使用他人的企业名称或者姓名,引人误认为是他人的商品及违反本条例第九条规定对商品质量作引人误解的虚假表示的,由监督检查部门责令停止违法行为、公开更正,没收违法所得,并可根据情节处以违法所得一倍以上五倍以下的罚款;没有违法所得的,处以一万元以下的罚款;情节严重的,责令停业整顿,吊销营业执照;对尚未售出的可能危害人体健康、危及人身财产安全的商品的处理,参照《中华人民共和国产品质量法》第三十七条、第四十条的规定执行。 Article Twenty-nine. Where an operator violates the provision in Article Eight of the Regulations by using at discretion the names or company names of any other party, so as to lead the people to believing that a commodity is the other party’s commodity, or violates the provision in Article Nine of the Regulations by making any misleading statements on the quality of a commodity, the supervision and inspection department shall require the operator to stop the illegal act and correct it publicly, forfeit the illegitimate income, and impose a penalty that is not less than one time but not more than five times of the illegitimate income, depending on the seriousness of the act; where there is no any illegitimate income, a penalty that is not more than 10,000 Yuan shall be imposed; where the act is very serious, the department shall require it to close down its business for reorganization, and cancel its business license; the provisions in Article Thirty-seven and Forty of the Law of the People’s Republic of China on Product Quality shall be referred to for the disposal of commodities that are not sold yet but may impair the health of people or the safety of lives or properties.

第三十条 经营者违反本条例第十条第一款规定利用广告等手段作虚假宣传的,由监督检查部门责令停止违法行为,并可根据情节处以一万元以上二十万元以下罚款。Article Thirty. Where an operator violates the provision in Item 1, Article Ten of the Regulations by making fraudulent promotions via advertising or other means, the supervision and investigation department shall request it to stop its illegal act, and may impose a penalty that is not less than 10,000 Yuan but not more than 200,000 Yuan, depending on the seriousness of the act.
广告经营者违反本条例第十条第二款规定代理、设计、制作、发布虚假广告的,由监督检查部门责令停止违法行为,没收广告费用,并可根据情节处以广告费用一倍以上五倍以下的罚款;情节严重的,依法停止其广告业务。 Where an advertising operator violates the provision in Item 2, Article Ten of the Regulations by acting as the agent for, designing, producing or distributing any fraudulent advertisement, the supervision and investigation department shall request it to stop the illegal act, forfeit the advertising expenses, and impose a penalty that is not less than one time but not more than five times of the advertising expense, depending on the seriousness of the act; where the act is very serious, the department may suspend its advertising business according to laws.

第三十一条 经营者违反本条例第十一条第一款规定捏造、散布虚伪事实,损害竞争对手的商业信誉、商品声誉的,监督检查部门应当责令其停止违法行为,消除影响。 Article Thirty-one. Where an operator violates the provision in Item 1, Article Eleven of the Regulations by fabricating or distributing any false information to damage the business credit or commodity credit of its competitors, the supervision and inspection department shall request it to stop its illegal act and remove the effects.

经营者违反本条例第十一条第二款规定利用广告贬低其他经营者商品的,由监督检查部门责令公开更正,没收广告费用,并可根据情节处以广告费用一倍以上五倍以下的罚款。Where an operator violates the provision in Item 2, Article Eleven of the Regulations by denouncing the commodities of other operators in advertisements, the supervision and investigation department shall request it to correct its act publicly, forfeit the advertising expense, and impose a penalty that is not less than one time but not more than five times of the advertising expense, depending on the seriousness of the act.

第三十二条 经营者违反本条例第十三条规定违背消费者意愿搭售商品或者附加其他不合理条件的,由监督检查部门责令改正,消费者有权退货,对拒不退货的,可根据情节处以所搭售商品价格一至二倍的罚款。 Article Thirty-two. Where an operator violates the provisions in Article Thirteen of the Regulations by attaching any other commodities for sale or attaching any other unreasonable conditions against the will of the consumers, the supervision and inspection department shall request remedy, and the consumers shall have the right to reject the commodities. Where the operator refuses to accept the rejected commodities, a penalty that is one to two times of the price of the attached commodities may be imposed, the amount of the penalty to be decided depending on the seriousness of the act.

第三十三条 经营者违反本条例第十四条规定实施强制交易行为的,由监督检查部门责令改正;违反治安管理规定的,由公安机关依照《中华人民共和国治安管理处罚条例》予以处罚。 Article Thirty-three. Where an operator violates the provisions in Article Fourteen of the Regulations by forcing any transaction, the supervision and inspection department shall request remedy; where any operator breaches any regulation on public security management, the public security authority may impose a sanction according to the Regulations of the People’s Republic of China on Punishments in Respect to the Management of Pubic Security.

第三十四条 经营者违反本条例第十五条规定进行有奖销售的,由监督检查部门责令停止违法行为,并可根据情节处以一万元以上十万元以下的罚款。 Article Thirty-four. Where an operator violates the provisions in Article Fifteen of the Regulations in offering any commodities with prizes attached, the supervision and inspection department shall require it to stop its illegal act, and may impose a penalty that is not less than 10,000 Yuan but not more than 100,000 Yuan, depending on the seriousness of the act.

第三十五条 经营者违反本条例第十六条规定采用财物或者其他手段进行贿赂以销售或购买商品的,由监督检查部门根据情节处以一万元以上二十万元以下的罚款,有违法所得的,予以没收;构成犯罪的,依法追究刑事责任。 Article Thirty-five. Where an operator violates the provisions in Article Sixteen of the Regulations by making any bribe by offering property, tourist holidays or any other means for the sale or purchase of a commodity, the supervision and inspection department shall impose a penalty that is not less than 10,000 Yuan but not more than 200,000 Yuan, depending on the seriousness of the act, and forfeit the illegitimate income if there is any; where a crime is constituted, the operator shall be prosecuted his/her criminal liabilities.

第三十六条 经营者违反本条例第十七条规定侵犯商业秘密的,由监督检查部门责令停止违法行为,并可根据情节处以一万元以上二十万元以下的罚款。 Article Thirty-six. Where an operator violates the provisions in Article Seventeen of the Regulations by infringing on any business secret, the supervision and inspection department shall request it to stop its illegal act, and may impose a penalty that is not less than 10,000 Yuan but not more than 200,000 Yuan, depending on the seriousness of the act.

第三十七条 投标者和招标者违反本条例第十八条规定相互串通、排挤其他竞争对手的,其中标无效。监督检查部门可根据情节处以一万元以上二十万元以下的罚款。 Article Thirty-seven. Where any tenderer and the tender inviting party violate the provisions in Article Eighteen of the Regulations by conspiring with each other to exclude the other competitors, the successful tender shall be nullified, and the supervision and investigation department may impose a penalty that is not less than 10,000 Yuan but not more than 200,000 Yuan, depending on the seriousness of the act.

第三十八条 公用企业或者其他依法具有独占地位的经营者违反本条例第十九条规定利用自己特有的地位排挤其他竞争对手的,由省级或地市级监督检查部门责令停止违法行为,并可根据情节处以五万元以上二十万元以下的罚款。被指定的经营者借此销售质次价高的商品或者滥收费用的,由监督检查部门没收违法所得,并可根据情节处以违法所得一倍以上三倍以下的罚款。Article Thirty-eight. Where a public institution or an operator that dominates a monopoly position according to relevant laws violates the provisions in Article Nineteen of the Regulations by taking the advantage of their special position to exclude other competitors, the supervision and investigation department at the province or city level shall request it to stop the illegal act, and may impose a penalty that is not less than 50,000 Yuan but not more than 200,000 Yuan, depending on the seriousness of the act. Where a designated operator makes use of the opportunity to sell inferior commodities in a higher price or charge indiscriminate fees, the supervision and investigation department shall forfeit its illegitimate income, and may impose a penalty that is not less than one time but not more than three times of the illegitimate income, depending on the seriousness of the act.

第三十九条 政府及其所属部门违反本条例第二十条规定滥用行政权力,限制经营者正当经营活动的,由上级机关责令其改正;情节严重的,由同级或者上级机关对直接责任人员给予行政处分。被指定的经营者借此销售质次价高商品或者滥收费用的,由监督检查部门没收违法所得,并可根据情节处以违法所得一倍以上三倍以下的罚款。 Article thirty-nine. Where a government or any of its subordinate departments violates the provisions in Article Twenty of the Regulations by misusing its administrative powers and restricting the proper business activities of any operator, its superior authority shall require remedy; where the act is very serious, the authority at the same or above level shall impose administrative sanctions to the persons immediately responsible. Where a designated operator makes use of the opportunity to sell inferior commodities in a higher price or charge indiscriminate fees, the supervision and investigation department shall forfeit its illegitimate income, and may impose a penalty that is not less than one time but not more than three times of the illegitimate income, depending on the seriousness of the act.

第四十条 经营者违反本条例第二十一条第一款第三项规定,销售或者转移、隐匿、销毁监督检查部门责令其暂停销售、听候查处的财物的,监督检查部门可根据情节处以被销售或者转移、隐匿、销毁财物的价款的一倍以上三倍以下的罚款。 Article Forty. Where an operator violates the provision in Point 3, Item 1, Article Twenty-one of the Regulations by selling, removing, concealing or destroying any property that the supervision and investigation department has required the operator to temporarily suspend the selling and waiting for inspection, the supervision and investigation department may impose a penalty that is not less than one time but not more than three times of the price of the properties sold, removed, concealed or destroyed, depending on the seriousness of the act.

第四十一条 拒绝、阻碍监督检查部门依法监督检查不正当竞争行为,违反治安管理规定的,由公安机关依照《中华人民共和国治安管理处罚条例》予以处罚。 Article Forty-one. Where any party violates the regulations on the management of public security by refusing or impairing the lawful supervision and inspection over an act of unfair competition carried out by a supervision inspection department, the party shall be punished by the public security authority according to the Regulations of the People’s Republic of China on Punishments in Respect to the Management of Pubic Security.

第四十二条 监督检查部门及其工作人员滥用职权、玩忽职守、徇私舞弊的,给予行政处分;给当事人造成经济损失的,依法承担行政赔偿责任;构成犯罪的,依法追究刑事责任。 Article Forty-two. Where a supervision and inspection department or any of its functionaries abuses his/her powers, neglects his/her duty, or practices irregularities for selfish interest, he/she shall be imposed administrative sanctions; where any economic loss is caused to any party, he/she shall bear the administrative responsibility for compensation according to laws; where a crime is constituted, he/she shall be prosecuted his/her criminal liabilities according to laws.

第四十三条 监督检查部门及其他国家机关工作人员利用职权,支持、包庇、纵容不正当竞争行为的,应当追究其行政责任;构成犯罪的,依法追究刑事责任。 Article Forty-three. Where any functionary in a supervision and inspection department or any other state organ takes advantage of his/her powers to support, cover up or indulge any act of unfair competition, he/she shall be prosecuted his/her administrative responsibilities; where a crime is constitute, he/she shall be prosecuted his/her criminal liabilities.

第四十四条 当事人对行政处罚决定不服的,可依法申请复议或者提起诉讼。逾期不履行行政处罚决定的,作出行政处罚决定的监督检查部门可依法申请人民法院强制执行。Article Forty-four. Where any party concerned refuses to accept the decision on an administrative sanction as final, he/she may apply for appeal or file a lawsuit in a legal manner. Where a decision on an administrative sanction is not executed within the specified period, the supervision and inspection department that has made the decision on the administrative sanction may file an application to a people’s court for compulsory execution according to laws.

第五章 附 则 Chapter Five, Supplementary Provisions
第四十五条 本条例自1998年1月1日起施行。 Article Forty-five. The Regulations shall become effective as of Jan. 1st 1998.
